This agreement is for the protection of our customers and systems and is fairly
standard legal-ese. Its main purpose is to prevent illegal or abusive practices

Refund Policy:

Due to the nature of the business we usually don't offer refunds, but we do offer refunds in some cases you can always email us.

Unwanted Material:

Any material or files that are, in our sole discretion, illegal, libelous, encourage conduct that would constitute a criminal offense, or otherwise violate any local, state, national, or international law or legislation are not permitted to be transferred by way of our services. Transmission, distribution, or storage of any information, data, or material in violation of United States or state regulation or law is prohibited. Copyright, trademark, or trade secret material may not be used without the permission of its respectful owner.

Adult Content:

Adult-oriented sites, pornography and sex-related merchandising are allowed only on our web hosting servers, you are not allowed to host any adult content on our shell hosting servers. This includes sites that may infer sexual content or provide links to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to our servers or any other server on the Internet, or provide links to such sites. Child Pornography is strictly prohibited.

Server Abuse:
 
Any attempt to undermine or cause harm to a server, or customer of Botseller is strictly prohibited. Offenders will be prosecuted to the fullest extent of the law.
Inviting/Spamming on IRC is also not tolerated, if found your account shall be terminated with no refunds. Going against the AUP of any IRC server/network using our server is also considered as abuse and if ever found your account shall be terminated with no refunds.

Service Cancellation Policy:

If at any point of time you plan to cancel your service, you should inform Botseller 24 hours before the date when you want to cancel it, you can inform by submitting a ticket for the billing department. if you don't inform about it you will be liable to pay for the next billing cycle. If dues are not paid we reserve the right to suspend or terminate your account and also reserve the right to even suspend/freeze/takeover your domain to recover the funds.

Investigation of Violations:

Botseller may investigate any reported or suspected violation of this Agreement, its policies or any complaints and take any action that it deems appropriate and reasonable under the circumstance to protect its systems, facilities, customers and/or third parties. Botseller will not access or review the contents of any e-mail or similar stored electronic communications except as required or permitted by applicable law or legal process.

Actions:

Botseller reserves the right and has absolute discretion to restrict or remove from its servers any content that violates this Agreement or related policies or guidelines, or is otherwise objectionable or potentially infringing on any third party's rights or potentially in violation of any laws. If we become aware of any possible violation by you of this Agreement, any related policies or guidelines, third party rights or laws, Botseller may immediately take corrective action, including, but not limited to, (a) issuing warnings, (b) suspending or terminating the Service, (c) restricting or prohibiting any and all uses of content hosted on Botseller systems, and/or (d) disabling or removing any hypertext links to third party Web sites, any of your content distributed or made available for distribution via the Services, or other content not supplied by Botseller which, in Botseller 's sole discretion, may violate or infringe any law or third-party rights or which otherwise exposes or potentially exposes Botseller to civil or criminal liability or public ridicule. It is Botseller policy to terminate repeat infringers. Botseller right to take corrective action, however, does not obligate us to monitor or exert editorial control over the information made available for distribution via the Services. If Botseller takes corrective action due to such possible violation, Botseller  shall not be obligated to refund to you any fees paid in advance of such corrective action.

Disclosure Rights:

To comply with applicable laws and lawful governmental requests, to protect Botseller systems and customers, or to ensure the integrity and operation of Botseller business and systems, Botseller may access and disclose any information it considers necessary or appropriate, including, without limitation, user profile information (i.e., name, e-mail address, etc.), IP addressing and traffic information, usage history, and content residing on Botseller servers and systems. Botseller also reserves the right to report any activity that it suspects violates any law or regulation to appropriate law enforcement officials, regulators, or other appropriate third parties.

Commercial Advertising - Email:

Spamming, or the sending of unsolicited email, from a Botseller server or using an email address or domain that is maintained on an Botseller machine as reference is STRICTLY prohibited. Botseller will be the sole arbiter as to what constitutes a violation of this provision.


Data Integrity:

The subscriber is responsible for keeping a complete and current copy of their website files as a backup on a remote system (not solely on Botseller servers).

Botseller is NOT RESPONSIBLE for any lost files, information or data.

Botseller makes regular internal backups of internal system configurations and databases. These backups are NOT intended for keeping backups of subscriber websites.

Although Botseller backups may include subscriber sites and information for disaster recovery purposes, these backups are not to be relied on by the subscriber. Botseller does not guarantee to possess the most current copy of a subscriber's website in its own backups.

Service Availability:

We try maintain a 99.9% uptime, but Botseller offers no guarantee for uptime due to the nature of the business.
We shall have the right to suspend the Services at any time and for any reason without notice, but if such suspension lasts or is to last for more than 30 days you will be notified of the reason.

The Services provided to you here under and your account with us cannot be transferred or used by anyone other than you. No more than one login session under any one account may be used at any time by you. User programs may be run only during login sessions. If your account is found to have been transferred to another party, or shows other activity in breach of this sub clause, we shall have the right to cancel the account and terminate the Services and/or this Agreement immediately. 

Interruption of Service:

You hereby acknowledge and agree that Botseller will not be liable for any temporary delay, outages or interruptions of the Services. Further, Botseller shall not be liable for any delay or failure to perform its obligations under this Agreement, where such delay or failure results from any act of God or other cause beyond its reasonable control (including, without limitation, any mechanical, electronic, communications or third-party supplier failure).

Server Resources:

Any web site or process that uses a high amount of server resources (such as, but not limited to, CPU time, memory usage, and network resources) will be given the option to either pay additional fees (which will depend on the resources required), reduce the resources used to an acceptable level. Botseller shall be the sole arbiter of what is considered to be a high server usage level. Any web hosting account deemed to be adversely affecting server performance or network integrity will be shut down without prior notice.

Limitation Of Liability: 

Botseller customers agree to indemnify and hold harmless Botseller from any claims resulting from the use of our services that damages them or any other party. The Botseller service is provided on an as is, as available basis without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose or non-infringement. Botseller expressly disclaims any representation or warranty that the Botseller service will be error-free, secure or uninterrupted. No oral advice or written information given by Botseller, its employees, licensors or the like, will create a warranty; nor may you rely on any such information or advice. Botseller and its partners and suppliers will not be liable for any cost or damage arising either directly or indirectly from any transaction or use of the service.


Failure to Pay:

Botseller may temporarily deny or terminate service upon the failure of the subscriber to pay the charges when due. Such termination or denial will not relieve the subscriber of responsibility for the payment of all accrued charges and any collection fees.

Modification:

Botseller reserves the right to add, delete, or modify any provision of its Terms of Use at any time without notice.


Suspension:

Activity which results in a suspension or deactivation of an account will result in a forfeiture of fees paid. Complaints made regarding abuses of an account will be grounds for suspension.


Refusal of Service:

We reserve the right to refuse, cancel, or suspend service at our sole discretion.


Failure to follow any term or condition will be grounds for immediate account deactivation.
